This is an odd history of surface-document appeared, suggesting that Apple is trying to control how its products are used in other promotions.

Here is the alleged document (PDF available here):

If the document is true (I don’t like relying on electronic documents as evidence for anything, I can easily make one document that I am the King of the world …) it is certainly odd. I would say that anyone who handed over legally purchased Apple product is protected by the first sale doctrine, regardless of what says Apple. I can’t see what the event, Apple should prevent gives away free iPads, iPhones and iPhone gift cards outside refuse to sell these products to those who participate in the first place.

I suppoose that Apple can mount some kind of a trademark claim for the use of product images of even thousands of a font (which Apple used its market things), but even then it is nakucvat case, and Apple may reach pounding sand endlessly.

I guess that Apple might be trying to use to cool all the “free iPAD/iPHONE” fraud will be, but even then I don’t see it having any effect.

Any ideas?
